2. INTELLECTUAL PROPERTY RIGHTS
2.1 All intellectual property rights in this site, and in the material published on it are owned by SpellingPlay Ltd. These works are protected by copyright law. All such rights are reserved.
2.2 You may print off copies and download extracts, of any page(s) on the website to use for educational purposes.
2.3 You must not use any part of the materials on this site for commercial purposes.
3. ACCESS
3.1 You are responsible for making all arrangements necessary for you to have access to this site. You are responsible for providing and maintaining suitable computer hardware, software and telecommunications equipment and services to enable you to access the site.
3.2 Access to free areas of the website is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on this site without notice. We will not be liable if for any reason the free site is unavailable at any time or for any period.
3.3 It is technically impractical to provide a fault free service and we do not undertake to do so. We will however make every reasonable effort to repair any reported faults as soon as is possible.
3.4 Occasionally it may be necessary to temporarily suspend the website for reasons such as: repair, maintenance or improvement of the service. Where reasonably practicable, we will give prior online notice of such a suspension and we will restore the service as soon as we reasonably can.
4. SECURITY
4.1 In order to access the 'subscription only' areas of the website, subscribers will be issued a login and unique password. You are responsible for the security and proper use of logins and passwords. You must take all necessary steps to ensure that they are kept confidential, used properly and not disclosed to unauthorised people.
4.2 You must immediately inform us if there is any reason to believe that a login or password has or is likely to become known to someone not authorised to use it or is being used in an unauthorised way.
4.3 Different levels of subscription indicate clearly the number of users that may make use of a given login and password. It is your responsibility that this number is never exceeded.
4.4 Whole school subscriptions do not permit pupils to access the website from home. Schools must not inform parents of school login and password details. Login and password details should not be shared on newsletters or on school websites.
4.5 We reserve the right to disable a login or password at any time if, in our opinion, you have failed to comply with these terms.
5. INFORMATION ABOUT YOU
5.1 Any information that is collected about you will be processed in accordance with the SpellingPlay privacy policy. By using this site, you consent to such processing and you warrant that all data provided by you is accurate.
6. OUR LIABILITY
6.1 We aim to provide material which is as accurate as possible. However, the material displayed on this site is provided without any guarantees, conditions or warranties as to its accuracy.
6.2 By using this site, you accept that you are doing so at your own risk and that we may not be held responsible for any losses either direct or consequential.
6.3 We are not liable for the acts or omissions of other providers of telecommunications or Internet services or for faults in or failures of their equipment.
7. PAYMENTS AND CANCELLATION
7.1 All subscriptions will be pre-paid yearly.
7.2 Following the purchase of a subscription you have a fourteen day cooling off period during which you may cancel the subscription and receive a full refund. In order to cancel the subscription, please contact us by e-mail at [email protected]
7.3 At any point during your membership you may cancel the membership by contacting us by e-mail at [email protected]. However, after the fourteen day cooling off period, members who have pre-paid for a yearly membership will not be given a refund for the unused portion of their membership.
7.4 We reserve the right to change the amount of, or basis for determining any fees or charges. Any changes to fees will be introduced when the new fees are published on the website.
7.5 All online payments are processed through PayPal, which securely handles all transactions and doesn't share your credit card or banking information with us. You do not need a PayPal account to make a payment. If you have any queries relating to your transaction please contact PayPal.
7.6 All online payments and refunds are subject to the terms and conditions published on the PayPal website.
7.7 Offline payments (by cheque) will only be accepted for Whole School Subscriptions by UK schools and must be accompanied by a completed order form. Subscriptions will be created and activated when both the cheque and order form are received by post. Unfortunately, items sent by post are sometimes subject to delay and may even become lost in the post. We cannot be held accountable should either of these occur. Please contact us at [email protected] if you are concerned that your payment has not been received.
7.8 If a cheque is returned by your bank, your subscription will be suspended. You will be contacted as soon as possible to inform you that this has taken place. Your subscription will only be reinstated when full payment has been received and been cleared.
7.9 Official purchase orders will only be accepted for Whole School Subscriptions by UK schools. Please send the purchase order accompanied by a completed order form by post or fax. Subscriptions will be created and activated when both the purchase order and order form are received by us. We will invoice you and payment in full will be required within 30 days. If payment is not received within 30 days, your subscription may be suspended until payment is received.
7.10 Payment by BACS will only be accepted for Whole School Subscriptions by UK schools. Please email us at [email protected] to arrange this.
8. VARIATIONS
8.1 We may revise these terms of use at any time by amending this page. You are expected to check this page from time to time to take notice of any changes made, as they are binding on you. Some of the provisions contained in these terms of use may also be superseded by provisions or notices published elsewhere on the site.
9. VIRUSES, HACKING AND OTHER OFFENCES
9.1 You must not misuse this site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to this site, the server on which this site is stored or any server, computer or database connected to this site.
9.2 By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use this site will cease immediately.
9.3 We cannot warrant that this site; information, content, materials (including software) or services included on or otherwise made available through this site; or e-mail sent from addresses ending @spellingplay.co.uk are free from viruses or other harmful components.
9.4 We will not be liable for any loss or damage caused by viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of this site or to your downloading of any material posted on it, or on any website linked to it.
